PERSONAL DATA PROCESSING POLICY

1. GENERAL PROVISIONS

1.1. This Policy on Personal Data Processing (hereinafter referred to as the “Policy”) has been developed in accordance with the Law of the Republic of Kazakhstan No. 94-V dated May 21, 2013 “On Personal Data and Its Protection”, the Civil Code of the Republic of Kazakhstan, and other regulatory legal acts of the Republic of Kazakhstan.

1.2. The Policy defines the procedure for collecting, storing, processing, protecting, and transferring personal data of Users of the skyrabbit.kz website (hereinafter referred to as the “Site”).

1.3. Use of the Site, including submitting requests via feedback forms, confirms the User’s consent to the terms of this Policy. If the User does not agree with the terms, they must refrain from using the Site.

1.4. The Operator reserves the right to make changes to the Policy. The current version is always available via the link in the Site footer.

3. COMPOSITION AND PURPOSES OF PERSONAL DATA PROCESSING

3.1. The Operator processes the following categories of personal data voluntarily provided by the User:

• Surname, first name (if provided);
• Contact phone number and/or Telegram nickname;
• Email address;
• Request text / project description / technical specification;
• Technical data: IP address, browser type, visit time (collected automatically).

3.2. Processing purposes:

• Processing incoming requests and initial communication with potential clients;
• Preparation of commercial proposals and project cost estimates;
• Execution of agreements for website development / service provision (upon conclusion);
• Technical support and project maintenance;
• Ensuring proper functioning of the Site;
• Collection of anonymized traffic statistics via Yandex.Metrica to improve Site quality.

3.3. The Operator does not process special categories of personal data (race, health, beliefs, etc.), nor data of minors (under 16 years of age).

4. LEGAL GROUNDS AND PROCEDURE FOR OBTAINING CONSENT

4.1. Personal data processing is carried out on the following legal grounds:

• Explicit, voluntary, specific, and informed consent of the User;
• Necessity for performance of a contract to which the User is a party;
• Legitimate interest of the Operator in business development and service quality improvement.

4.2. Consent to personal data processing is provided by the User by checking a box in the request submission form with the wording: “I consent to the processing of my personal data in accordance with the Privacy Policy.”

4.3. Consent may be withdrawn by the User at any time by sending a written request to: info@skyrabbit.kz. Withdrawal of consent does not affect the lawfulness of processing carried out prior to its receipt.

5. DATA STORAGE, LOCALIZATION, AND PROTECTION

5.1. Databases containing personal data of citizens of the Republic of Kazakhstan are stored and processed exclusively on servers physically located within the territory of the Republic of Kazakhstan.

5.2. Personal data received through request forms are not subject to long-term storage: after processing the request and completing communication, data are deleted from the Operator’s working systems, unless a service agreement has been concluded between the Parties.

5.3. In case of agreement conclusion, data are stored in the volume necessary for fulfillment of contractual obligations and compliance with the requirements of RK legislation (including tax accounting).

5.4. The Operator applies necessary organizational and technical measures to protect data, including:

• Use of secure HTTPS protocol (SSL encryption);
• Restriction of access to personal data exclusively to the responsible person (Director);
• Regular backup procedures;
• Use of licensed software and antivirus protection.

6. TRANSFER OF PERSONAL DATA TO THIRD PARTIES

6.1. The Operator does not transfer Users’ personal data to third parties, except in the following cases:

• When necessary for performance of a contract with the User (e.g., transferring data to a hosting provider for placing the Customer’s website);
• When required in accordance with RK legislation (upon request of authorized state bodies).

6.2. The Operator does not use third-party CRM systems, messenger APIs, chatbots, or mailing services for processing personal data.

6.3. Cross-border transfer of personal data is not carried out, except in cases provided for by RK legislation.

7. USE OF COOKIES AND YANDEX.METRICA

7.1. The Site uses cookies and the Yandex.Metrica web analytics service to collect anonymized traffic statistics (number of visits, traffic sources, user behavior).

7.2. Data collected by Yandex.Metrica does not allow identification of a specific User and is used exclusively in aggregated form to improve Site quality.

7.3. Yandex.Metrica may carry out cross-border transfer of anonymized data to servers located outside the Republic of Kazakhstan, in accordance with Yandex’s privacy policy.

7.4. The User has the right to disable data collection through browser settings or via the Yandex.Metrica service: [link to Yandex opt-out].

8. RIGHTS OF THE PERSONAL DATA SUBJECT

The User has the right to:

8.1. Receive information about the processing of their personal data.

8.2. Demand clarification, blocking, or deletion of data if it is incomplete, outdated, inaccurate, or processed unlawfully.

8.3. Withdraw consent to personal data processing.

8.4. Challenge the actions or inaction of the Operator before the authorized personal data protection authority or in court.

9. PROCEDURE FOR HANDLING REQUESTS

9.1. Requests concerning personal data shall be sent to: info@skyrabbit.kz or to the Operator’s legal address.

9.2. The Operator reviews inquiries and provides responses within a period not exceeding 15 (fifteen) business days from the date of receipt of the request, in accordance with Article 18 of the Law of the RK “On Personal Data and Their Protection.”

9.3. If it is impossible to satisfy the request, the Operator provides a reasoned response indicating the legal grounds.

10. FINAL PROVISIONS

10.1. This Policy enters into force from the moment of its publication on the Site and remains in effect indefinitely until amended.

10.2. All disputes arising in connection with personal data processing shall be resolved through negotiations. In case of failure to reach agreement – in accordance with the legislation of the Republic of Kazakhstan.

10.3. The User confirms that they have read and unconditionally accept the terms of this Policy.
